Information shall not be used to commit a crime or to engage in illegal discrimination or harassments of an offender. Any person who uses information disclosed pursuant to M.G.L. C. 6 §§ 178C - 178P for such purposes shall be punished by not more than two and one half (2 ½) years in a house of correction or by a fine of not more than one thousand dollars ($1000.00) or both ( M.G.L. C.6, § 178N). In addition, any person who uses Registry information to threaten to commit a crime may be punished by a fine of not more than one hundred dollars ($100.00) or by imprisonment for not more than six (6) months ( M.G.L. C. 275 § 4).

Pursuant to M.G.L. C. 6, §§ 178C - 178P, the individuals who appear on the following notifications have been designated a Level 3 Sex Offenders by the Sex Offender Registry Board. The Board has determined that these individuals have a high risk to reoffend and that the degree of dangerousness posed to the public is such that a substantial public safety interest is served by active community notification.

The Westfield Police Department is releasing the following information pursuant to M.G.L. C. 6 §§ 178C-178P which authorizes law enforcement agencies to release information that will enhance public safety and protection. The individuals who appear on this notification have been convicted of a sex offense that requires his/her registration. These people have been designated as a LEVEL 3 SEX OFFENDER by the Sex Offender Registry Board. The Board has determined that these individuals are at a high risk to re-offend and that the degree of dangerousness posed to the public is such that a substantial public safety interest is served by active community notification. These people have served the sentence imposed on him/her by the court and IS NOT WANTED BY THE POLICE.

 

Law Enforcement agencies have no authority to direct where a sex offender lives or works. Unless court ordered restrictions exist, this offender is constitutionally free to live wherever he/she chooses. Sex offenders have always lived in our community however, it was not until the passage of this law (which mandates sex offender registration) that law enforcement agencies could share this information with the public. Any abuse of this information to threaten, intimidate or harass registered sex offenders will not be tolerated and could potentially jeopardize our authority to keep the public informed.

 

Any member of the public who is 18 years of age or older may request sex offender information in person at the Westfield Police Department Records Department. After presenting proper identification, the requester must fill out a sex offender request form. Sex offenders are classified according to the degree of dangerousness they pose to the public and their likelihood to re-offend. The classifications are as follows:

• Level 1 or "low risk" offender

• Level 2 or "moderate risk" offender

• Level 3 or "high risk" offender

• Level 3+ sexually violent predator

Information about a sex offender is available to the public only if the offender has a duty to register and has been finally classified by the Board as a Level 2 or a Level 3 offender. Current law prohibits the dissemination of information unless and until the offender is finally classified as a Level 2, Level 3, or Level 3+ offender. The law strictly prohibits the dissemination of information on Level 1 (low risk) offenders.
